1. Who we are
This website is operated by NxtCar Pty Ltd (“NxtCar”, “we”, “us”). By using nxtcar.com.au you agree to these terms. If you hire a vehicle from us, that hire is governed by a separate written hire agreement provided to you before the hire begins — these website terms do not replace it.
2. What our service is
NxtCar provides accident replacement vehicles to eligible drivers who were not at fault in a motor vehicle accident, servicing greater Melbourne, Victoria. NxtCar is not an insurer, does not provide credit regulated by the National Consumer Credit Protection Act 2009 (Cth), and does not provide legal advice. Information on this site is general in nature.
3. What “no cost to you” means
Where this website says a replacement vehicle is provided at “no cost to you”, “$0 out of pocket” or similar, it means that, for eligible not-at-fault drivers, we seek to recover our hire charges from the at-fault party and/or their insurer rather than from you. This is subject to the following conditions:
- You must meet our eligibility criteria, including that you were not at fault in an accident involving another identifiable vehicle;
- You must provide true, accurate and complete information about the accident;
- You must sign our hire agreement and comply with its terms;
- You must provide reasonable assistance with the recovery of hire charges — this may include providing accident details, signing documents, providing a witness statement, and, where necessary, authorising or assisting recovery action taken in your name;
- You remain responsible for vehicle running costs during the hire, including fuel or charging, tolls, parking and any traffic or parking infringements, and for any damage liability as set out in the hire agreement.
If you were in fact at fault, or you provide false or misleading information, you may become liable for hire charges under the hire agreement.
4. Eligibility guidance is not a guarantee
Tools on this site (such as the eligibility checker) provide general guidance only. Final eligibility is determined when we review your accident details.
5. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms or our hire agreement excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or other applicable law that cannot lawfully be excluded.
6. Website content and availability
We take care to keep this website accurate and current, but we do not warrant it is error-free or always available. Content may change without notice. To the extent permitted by law, we are not liable for loss arising from reliance on general information on this site — call us to confirm anything that matters to your situation.
7. Intellectual property
All content on this site (text, graphics, logos and design) is owned by or licensed to NxtCar Pty Ltd and protected by law. You may view and print pages for personal use; any other reproduction requires our written consent.
8. Links to other sites
Links to third-party websites (such as regulators) are provided for convenience. We are not responsible for their content.
9. Privacy
Personal information submitted through this site is handled under our Privacy Policy.
10. Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
